Regulations

Various regulations have been issued by the government to protect the peat ecosystem.

The following are laws and regulations that provide technical elaborations regarding the protection and management of peat ecosystems:

  • Government Regulation No. 71 of 2014 concerning the Protection and Management of Peat Ecosystems, replaced by Government Regulation No. 57 of 2016
    This Government Regulation regulates systematic and integrated efforts to preserve and prevent damage to the peat ecosystem, which includes: planning, utilization, control, maintenance, supervision, and law enforcement.
  • Presidential Regulation (Perpres) No. 1 of 2016 concerning the Peat Restoration Agency, later updated to Presidential Regulation No. 120 of 2021
    This Presidential Regulation was issued in early 2016 to accelerate area recovery and restore the hydrological function of peat due to massive forest and land fires that occurred in 2015. The peat restoration commitment was then extended in early 2021 with the addition of a mangrove ecosystem as a restoration target.
  • Presidential Instruction No. 10 of 2011, renewed every 2 years until it became permanent through Presidential Instruction No. 5 of 2019
    This Presidential Instruction was issued to stop the issuance of new permits for the use of primary forest and peatland areas and to improve forest governance in primary forests and peatlands, aimed at preserving primary forests and peatlands and continuing efforts to reduce deforestation and degradation.
  • Regulation of the Minister of Environment and Forestry No. 14/MENLHK/SETJEN/KUM.1/2/2017 on procedures for the peat ecosystem inventory functionsRegulation of the Minister of Environment and Forestry No. 15/MENLHK/SETJEN/KUM.1/2/2017 on procedures measurement of ground water front at point peatland ecosystem adoptionMinister of Environment and Forestry No. 16/MENLHK/SETJEN/KUM.1/2/2017 concerning technical guidelines for the restoration of peatland ecosystem functions
    These three minister regulations contain technical steps to protect the ecological functions of peat ecosystems, aimed at supporting the preservation of biodiversity in peat ecosystems, as well as supporting peat ecosystems as water regulators, carbon stores, oxygen producers, and climate balancers.
  • Regulation of Minister of Environment and Forestry No. 10/MENLHK/SETJEN/KUM.1/3/2019 concerning Definition, Determination, and Management of Peat Dome Peak Based on Peat Hydrological Units
    This Minister Regulation contains guidelines on the procedure for defining the peat dome peak, to provide direction in the preparation of the Peat Ecosystem Protection and Management Plan, as well as as a basis for planning and implementing the restoration of the peat ecosystem functions.
